CALL TO ORDER President: Dennis Wentworth opened the meeting at 5:34 pm

ABSENT:   H. Burnett and K. Laesch (K. Laesch arrived at 5:40pm)

ADOPTION OF AGENDA

 

MOTION by S. Tobler, SECONDED BY Member R. Writer the agenda for the Special Board Meeting of February 12th, 2020 be adopted as written.

COMMUNITY DIALOGUE CITIZENS CONCERNS None

 

 

CLOSED SESSION – ATTORNEY-CLIENT PRIVELEGE MOTION BY Member J. DeVlaminck, SECONDED BY Member S. Tobler, The Buchanan Board of Education is to enter into closed session, under section 8(H) of the Open Meetings Act, to discuss the written opinion of legal counsel from the letter dated February 12th, 2020. Time: 5:37pm. Member K. Laesch arrived at 5:40pm.

RETURN TO OPEN SESSION MOTION BY Member J. DeVlaminck, SECONDED BY Member R. Writer, The Buchanan Board of Education returns to open session. Time 6:18pm.

NAYS:  None     MOTION ADOPTED

RESOLUTION OF PERSONNEL MATTER MOTION by D. Wentworth, SECONDED by S. Tobler,

WHEREAS, the Board of Education (the “Board) received a complaint on January 31 alleging harassment in violation of Board Policy 1662; and

 

WHEREAS, the Board will promptly and thoroughly investigate the complaint

 

WHEREAS, the Board has determined to appoint a third party to work with the Board President to ensure that the complaint is objectively and thoroughly investigated.

 

NOW, THEREFORE, BE IT RESOLVED THAT:

 

1.       The Board designates Thrun Law to investigate the allegations set forth in the complaint.

2.       The Board hereby authorizes the Investigator to identify the parameters of the complaint, investigate the underlying facts, and issue a report with factual findings so the Board may act.

3.       The Board directs that all School District employees cooperate fully with the Board President and the Investigator in carrying out the investigation. Employees are directed to answer questions related to this investigation honestly, truthfully, and without evasion. Further, the Board directs that no one is to take any action to interfere with the investigation, including, but not limited to, destruction of any records or retaliation against any employee working with the Board or involved in the investigation of the complaint. Failure to comply with these directives may result in discipline.

4.       All resolutions and parts of resolutions insofar as they conflict with the provisions of this resolution be the same are hereby rescinded.
